    <title>2025 (11) TMI 2086 - ITAT RAJKOT</title>
    <link>https://www.taxtmi.com/caselaws?id=472578</link>
<description>Revisionary jurisdiction under section 263 requires the assessment order to be both erroneous and prejudicial to the interests of the Revenue. Where the Assessing Officer has raised queries, examined replies and supporting material, and completed the assessment after applying mind, revision cannot rest merely on a preference for a deeper or more detailed enquiry. Inadequate enquiry, unlike a complete lack of enquiry, does not by itself establish an erroneous and prejudicial order. A legally sustainable assessment reached after examination of relevant material is therefore not amenable to revision on that basis.</description>
