    <title>2025 (12) TMI 1874 - ITAT MUMBAI</title>
    <link>https://www.taxtmi.com/caselaws?id=470352</link>
<description>For section 56(2)(x)(b), an allotment letter that fixes the property consideration and is followed by part payment through prescribed banking channels before execution of the registered sale agreement constitutes an agreement to sell. Where the agreement date differs from the registration date, the provisos permit adoption of the stamp duty value as on that earlier agreement date if consideration or part consideration was paid by the prescribed modes on or before that date. Accordingly, stamp duty valuation should be determined on the allotment date rather than the registration date, and an addition based on the latter value is unsustainable.</description>
