    <title>2017 (7) TMI 1488 - BOMBAY HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=469713</link>
<description>Statutory MSME purchase preference under the Micro, Small and Medium Enterprises Development Act, 2006 and the Public Procurement Policy applies only to procurement of goods and services simpliciter, not to a composite EPC tender amounting to a works contract. Because the tender required design, engineering, manufacture, supply, erection, commissioning and handing over of a fire water spray system, the MSME preference clause could not validly be invoked. The decision to allow the L-2 MSME bidder to match the L-1 price and receive the award was therefore based on an inapplicable preference and was quashed as arbitrary and illegal, while the tender process was otherwise left open for lawful reconsideration.</description>
