    <title>2025 (2) TMI 1974 - ITAT AGRA</title>
    <link>https://www.taxtmi.com/caselaws?id=469644</link>
<description>Cash deposits made during the demonetisation period were treated only partly as unexplained money because the cash book showed some availability, including rental income, but the withdrawals, drawings and deposit pattern were found insufficient to fully explain the entire cash trail. On a reasonable estimate, the addition under section 69A was restricted to 50% of the disputed deposits. The enhanced tax rate under section 115BBE was held inapplicable for the assessment year involved, as the higher rate was considered operative only from assessment year 2018-19 onwards; the amount was therefore directed to be taxed at the maximum marginal rate without the enhanced 60% rate.</description>
