<title>2026 (5) TMI 276 - NATIONAL COMPANY LAW APPELLATE TRIBUNAL PRINCIPAL BENCH, NEW DELHI</title>
    <link>https://www.taxtmi.com/caselaws?id=791074</link>
<description>Where an operational debt is founded on invoices, the demand notice must be served in the prescribed form with the supporting invoices; omission of the invoice particulars and attachments renders the notice defective and non-compliant. An email will not extend limitation unless it amounts to a clear acknowledgment of liability, and correspondence denying the debt and the underlying transaction does not satisfy that standard. A reply that categorically disputes liability and the nature of the transaction constitutes a genuine pre-existing dispute, and in such circumstances the Section 9 insolvency application cannot proceed and must be rejected.</description>
