    <title>2011 (6) TMI 1049 - ITAT DELHI</title>
    <link>https://www.taxtmi.com/caselaws?id=465650</link>
<description>Addition for cash deposits as unexplained income was unsustainable where the assessee had made substantial survey disclosures over multiple years, including the relevant year, and such disclosures for earlier years had been accepted in completed assessments without further additions. On a factual appreciation, the Tribunal held that the surrendered income constituted a plausible source of cash to explain the bank deposit, and the Revenue failed to establish that the disclosed amounts had been spent or invested elsewhere so as to be unavailable for deposit; accordingly, the addition towards the bank deposit was deleted. Consequentially, since the deposit stood explained, the assessment for the year was directed to be confined to the income surrendered during survey for that year, and relief was granted to that extent.</description>
