    <title>1988 (7) TMI 421 - PUNJAB AND HARYANA HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=462308</link>
<description>A compromise or consent decree concerning immovable property that is itself the subject-matter of the suit is not required to be registered, even where title is created for the first time under the decree. The Registration Act distinguishes such decrees from compromise decrees covering property outside the suit, and the exception in Section 17(2)(vi) preserves the former from compulsory registration. A consent decree also remains binding on the parties and cannot be reopened in a later suit unless vitiated by fraud, misrepresentation, coercion, mistake, or, in the case of minors or persons of unsound mind, negligence of the guardian or next friend. In the absence of such grounds, a collateral challenge is barred.</description>
