    <description>A belated request to send a cheque and related exhibits for handwriting or scientific examination may be refused where the drawer has admitted the signature and the request would further delay a Section 138 prosecution. The refusal was upheld because the accused had not first shown a basis to dispute fabrication or falsity through defence evidence. At the same time, the statutory presumption remains rebuttable, and the accused must be given a fair opportunity to lead defence evidence, including rebuttal scientific material, subject to avoiding inordinate delay. The trial court was directed to permit that opportunity.</description>
