    <title>2024 (9) TMI 707 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=758463</link>
<description>Preventive detention is invalid where statements forming an important link in the detaining authority&#039;s subjective satisfaction are not supplied to the detenu, because Article 22(5) requires disclosure of all relied-upon material for an effective representation. Material mentioned only casually need not be furnished. Article 22(5) also requires representations to be transmitted and considered with promptness, independently of the Advisory Board process. Casual forwarding, substantial unexplained delay, or administrative slackness in disposal infringes this constitutional safeguard and independently vitiates detention.</description>
