    <title>1970 (7) TMI 83 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=456275</link>
<description>A foreigner has no fundamental right under Article 19 to remain in India, and restraint imposed to secure expulsion or deportation under the governing statutory scheme is not illegal custody. Where a detention order under the Jammu and Kashmir Preventive Detention Act, 1964 was made for arrangements for expulsion, and the subsequent deportation order was issued under the Foreigners Act, 1946 pursuant to valid entrustment under Article 258, the restraint on liberty remained lawful. In such circumstances, habeas corpus relief is not available because the detention does not amount to unlawful deprivation of personal liberty.</description>
