    <title>2015 (6) TMI 1268 - GUJARAT HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=314043</link>
<description>The Gujarat HC quashed a remand order granting police custody after the statutory fifteen-day period had expired. The accused was arrested on 15th September 2014, produced before the Special Judge on 16th September 2014, but the remand order was passed on 25th March 2015, well beyond the fifteen-day limit. Relying on CBI v. Anupam J. Kulkarni, the HC held that police custody cannot be granted after expiry of the initial fifteen-day period from production before the magistrate under Section 167 CrPC. The court found serious error in the lower court&#039;s decision and allowed the petitioner&#039;s application.</description>
