    <title>2019 (3) TMI 2057 - BOMBAY HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=313666</link>
<description>The Bombay HC allowed a petition challenging a Lok Adalat award where third parties were excluded from litigation concerning property in Survey No. 104, Vadjai area. The court found that the same property was subject matter of both a 2000 partition suit (3 Acres 35 Gunthas) and a 2017 suit (7 Acres 19 Gunthas) from which petitioners were excluded. Relying on SC precedents, the court held that third parties qualify as &quot;aggrieved persons&quot; and can challenge Lok Adalat awards on grounds of fraud and misrepresentation when prima facie established. The Lok Adalat award was quashed and set aside.</description>
