    <title>1980 (4) TMI 325 - BOMBAY HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=313081</link>
<description>The revisional bar under the Code is personal to the party who has already invoked the revisional forum, so a High Court revision is not barred merely because the opposite side earlier moved the Sessions Judge. Section 399(3) gives finality only against the person by or on behalf of whom the Sessions revision was filed, and it does not extinguish the remedy of an aggrieved unsuccessful opposite party. The scheme of Sections 397, 399 and 402 therefore permits the defeated party before the Sessions Judge to approach the High Court in revision.</description>
