    <title>2008 (7) TMI 1094 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=312190</link>
<description>After charge is framed, the trial court cannot recall that order or reopen the stage of charge on the basis of material later produced by the accused. Alleged non-compliance with Section 207 of the Code of Criminal Procedure does not by itself render the charge void, and a discharge plea cannot be entertained after charges have been framed on that ground. The inherent power under Section 482 is exceptional and cannot be used for a roving inquiry or mini trial once sufficient material exists for framing charge. The Supreme Court therefore upheld the charges and proceedings and left the lower court orders undisturbed.</description>
