    <description>In a warrant case instituted otherwise than on a police report, the Magistrate is not invariably required to take evidence under Section 244 before framing charge. Sections 244, 245 and 246 operate as a scheme: evidence may be taken under Section 244 when produced by the prosecution, discharge may follow under Section 245, and Section 246 permits charge to be framed either after such evidence or at an earlier stage if there is ground for presuming the accused committed the offence. The statutory threshold under Section 246 therefore allows an earlier charge without prior evidence in an appropriate case.</description>
