    <title>1987 (9) TMI 432 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=310371</link>
<description>Section 116 of the Evidence Act, 1872 bars a tenant only from denying the landlord&#039;s title at the commencement of the tenancy and only during the tenancy&#039;s continuance. It does not prevent the tenant from showing that the landlord&#039;s title has since ended, or that the tenant was compelled by threat of eviction from a title paramount to attorn to the true owner. Where the tenant has attorned to the paramount title holder and pays rent to that person, eviction cannot be sustained on denial of title or alleged default in rent based on a supposed subsisting tenancy.</description>
