    <title>2009 (9) TMI 1073 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=309257</link>
<description>A decree passed in terms of an arbitral award cannot add post-award interest when the award granted only pre-reference and pendente lite interest. Where no objection was taken under Section 30 of the Arbitration Act, 1940 and a decree was sought under Section 17, the court had to remain within the award and could not enlarge it by granting a relief not awarded by the arbitrator. Any decree or execution order granting interest for the period after the award was therefore without jurisdiction to that extent and inexecutable.</description>
