    <title>2021 (2) TMI 1341 - KARNATAKA HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=307628</link>
<description>Against acquittals in complaints under Section 138 of the Negotiable Instruments Act, 1881, the complainant&#039;s proper remedy is a statutory appeal under Section 378(4) of the Code of Criminal Procedure, 1973, and not a criminal revision under Sections 397 and 401. The revisional route cannot be used as a substitute for the appeal remedy even if the complainant earlier pursued the wrong forum. The revision petitions were allowed to be withdrawn with liberty to file criminal appeals, subject to costs, and the time spent in the mistaken proceedings was directed to receive protection under Section 14 of the Limitation Act, 1963.</description>
