    <title>2022 (8) TMI 1321 - NATIONAL COMPANY LAW APPELLATE TRIBUNAL, NEW DELHI</title>
    <link>https://www.taxtmi.com/caselaws?id=305517</link>
<description>Under Section 61 of the Insolvency and Bankruptcy Code, the limitation period for an appeal runs from the date of pronouncement of the adjudicating order, not from the date of knowledge or receipt of a copy. Only the time needed to obtain a certified copy can be excluded, and the statutory scheme does not allow limitation to wait for a free copy under the Companies Act, 2013. Summer vacation of the tribunal does not extend time where filing remained available during that period. Delay beyond the further condonable period of fifteen days cannot be enlarged in view of binding Supreme Court authority.</description>
