    <title>2019 (11) TMI 1766 - GUJARAT HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=305468</link>
<description>Section 22 of the Sick Industrial Companies (Special Provisions) Act, 1985 barred recovery and coercive proceedings against a sick industrial company while its BIFR reference remained pending. The Gujarat HC held that the Debts Recovery Tribunal and recovery officer could not validly continue with recovery, execution, attachment or issue a recovery certificate during the statutory suspension, because orders made in breach of that bar are a nullity. The recovery proceedings, recovery certificate and attachment orders were therefore quashed, with liberty to proceed afresh in accordance with law.</description>
