The Intellectual Property Rights (Imported Goods) Enforcement Rules, 2007 permit customs to suspend clearance where there is reason to believe imported goods infringe intellectual property rights. Where customs has not permitted entry of a suspected infringing consignment, further injunctive relief against clearance may no longer be required. On a right holder's request, customs may provide the importer's name, address and other relevant details concerning a suspended consignment, subject to confidentiality and availability of the information. Customs is expected to apply the IPR enforcement framework to suspected infringing imports.
