    <title>2004 (4) TMI 658 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=304200</link>
<description>A will be construed to give effect to the testatrix&#039;s intention, and an absolute bequest to a hospital, coupled with executors&#039; assent, vested ownership in the hospital so the bungalow qualified as public premises under the Punjab Public Premises and Land (Eviction and Rent Recovery) Act, 1973. A fixed-term lease with only a renewal clause did not continue automatically; because no effective renewal was shown, possession after expiry became wrongful and unauthorized occupation. On that basis, eviction under the 1973 Act was competent and the contrary view on maintainability was set aside.</description>
