    <title>1970 (3) TMI 179 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=300695</link>
<description>Preventive detention requires the grounds of detention to be communicated in a language understood by the detenu so the statutory right of representation is real and effective; delivery of English grounds to an illiterate detenu, without proper explanation in a known language, was insufficient. The grounds must also contain enough particulars, including relevant persons, dates, occasions and alleged acts, to let the detenu meet the case against him; broad or indefinite allegations are legally vague. On these principles, the detention was treated as unlawful for breach of mandatory safeguards and the detenu was entitled to be released.</description>
