    <title>2022 (2) TMI 447 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=418196</link>
<description>Under the SARFAESI framework, a borrower can sale of a secured asset only by tendering the full dues with costs, charges and expenses before the prescribed stage. Payment of only the reserve price or reliance on an unfinalised highest bid does not discharge the liability or justify release of the mortgaged property. The Supreme Court therefore rejected the borrower&#039;s claim to retain or recover the secured asset on a lesser payment, restored the Single Judge&#039;s order, and left the bank free to proceed with the auction in accordance with law.</description>
