    <description>Under Section 167(2) of the Code of Criminal Procedure, the right to default bail arises only when the investigation is not completed and the charge-sheet or complaint is not filed within the statutory period. Timely filing of the charge-sheet or complaint satisfies the provision, and the absence of cognizance within the remand period does not revive or extend the right to statutory bail. Earlier references to cognizance were confined to their factual settings and did not create an additional condition. On that basis, the accused was not entitled to default bail where the complaint had been filed in time.</description>
