    <title>2021 (5) TMI 1003 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=299030</link>
<description>After rejecting anticipatory bail, a High Court may grant only limited interim protection in exceptional cases, and only by a reasoned order that is narrowly tailored to the facts and consistent with the statutory scheme, the needs of investigation, and the interests of the complainant and society. A fixed-period protective order cannot be treated as judicial largesse or an unstructured exercise of inherent power under the Code of Criminal Procedure. The Supreme Court set aside the unreasoned 90-day protection granted after refusal of anticipatory bail and held that the investigating agency could proceed according to law, with custody and bail to be considered by the competent court uninfluenced by the impugned orders.</description>
