    <title>2015 (3) TMI 1405 - MADRAS HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=298918</link>
<description>Purchase of property in a wife&#039;s name was treated as a benami claim only if the claimant pleaded and proved that the purchase was not for her benefit. The court accepted the evidence that the consideration came from the husband, but held that his own pleadings and proof showed the purchase was made out of love, affection, and for the wife&#039;s and minor son&#039;s benefit. On that basis, the suit for declaration and recovery was not maintainable under the Benami Transactions (Prohibition) Act, and the alleged family settlement or acknowledgment failed for want of proof. The second appeal succeeded and the suit was dismissed.</description>
