    <title>2008 (9) TMI 1020 - MADRAS HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=296914</link>
<description>Under the Tamil Nadu Co-operative Societies Act, 1983 and Rule 149 of the 1988 Rules, service conditions of a co-operative society, including scale of pay and allowances, are subject to a special by-law with prior Government approval. The society&#039;s Board cannot independently fix wages or enter into binding wage settlements outside that statutory framework. In the absence of a by-law under Rule 149, the Government may prescribe the minimum scale of pay. On that basis, wage fixation and the settlement in question were not legally sustainable, and the Government Orders were upheld.</description>
