During that interregnum, the unamended Patents Act continued to govern appeals from rejection of pre-grant opposition, so the High Court remained the proper appellate forum. The later regime could not remove a remedy already available at the time of institution, and the transfer provision did not authorise routing pre-grant matters to the Appellate Board, which had no jurisdiction over them.</description>
