    <title>2016 (7) TMI 1606 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=294354</link>
<description>Repeated adjournment requests and attempts to recall a witness may amount to abuse of process where a litigant shows persistent non-participation despite opportunities and costs. Courts are expected to curb delay tactics and enforce diligent prosecution of civil proceedings. The power to recall a witness under Order XVIII Rule 17 CPC is discretionary and to be used sparingly, mainly to clarify the court&#039;s doubts. It cannot be used to fill omissions, introduce fresh material, or prolong trial. Dilatory, frivolous, or negligent applications may therefore be rejected with costs to protect expeditious civil adjudication.</description>
