    <title>2020 (12) TMI 1213 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=293721</link>
<description>The right of residence under the Domestic Violence Act cannot be defeated by summary eviction proceedings under the Senior Citizens Act. Where both welfare statutes apply, they must be harmonised so that the Senior Citizens Act protects senior citizens without extinguishing a woman&#039;s independent statutory protection in a shared household under Sections 17 and 19 of the Domestic Violence Act. The definition of shared household is not dependent on title or ownership, and later transfers to in-laws do not by themselves nullify the residence claim. The eviction directions were set aside, and the appellant was left free to pursue her remedies under the Domestic Violence Act.</description>
