    <title>2017 (5) TMI 1743 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=290574</link>
<description>Preventive detention must rest on relevant and proximate material showing a present necessity to detain; stale incidents that are nine to fourteen years old do not provide the live and proximate link required for lawful subjective satisfaction. The Court also held that the detenu&#039;s custody did not justify detention where the authority relied on very old incidents instead of immediate and relevant material showing a future threat to public order. Reliance on remote past conduct was therefore extraneous to the statutory purpose and rendered the detention order unsustainable. The preventive detention order, and the High Court judgment upholding it, were set aside.</description>
