    <title>1934 (6) TMI 37 - BOMBAY HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=289248</link>
<description>For succession to an ancestral impartible estate, mere separate residence, separate messing or long estrangement does not extinguish the junior branch&#039;s right of succession; only express or implied renunciation of that chance can do so. Certified copies of an earlier decree and the pedigrees filed in that proceeding are admissible as public records and may operate as relevant admissions against successors in interest. A sale deed cannot be validly registered by inserting an insignificant, inaccessible item solely to create a colourable local registration basis; such a device does not genuinely relate to the property for registration purposes, and the instrument cannot affect the immovable property comprised in it.</description>
