    <description>A usufructuary mortgage of an occupancy holding was treated as a qualified arrangement, not a full transfer of the occupancy tenant&#039;s interest. On that settled view, the mortgage did not make the holding transferable, did not extinguish the mortgagor&#039;s right of redemption on expiry of the redemption period, and did not defeat statutory ejectment or possession proceedings under the U.P. Zamindari Abolition and Land Reforms Act, 1951. Applying stare decisis, the SC preserved the long-standing Allahabad High Court position and noted that the U.P. Debt Redemption Act, 1940 supported the self-liquidating character of such mortgages. The appellants therefore could not resist ejectment.</description>
