    <title>1940 (12) TMI 28 - BOMBAY HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=289181</link>
<description>A tenancy agreement may validly give lessees a contractual right to remove structures erected during the tenancy on its termination, and that bargain can displace the default rule under Section 108(B)(k) of the Transfer of Property Act. The right must be exercised within the period allowed by the contract or, at the latest, within a reasonable time after termination while the tenant still has the ability to act. If the tenant leaves possession and fails to remove the structures in time, all right, title and interest in them are lost and the structures are not liable to attachment.</description>
