    <title>1953 (2) TMI 53 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=288033</link>
<description>An order under clause 13 of the Letters Patent transferring a suit from a subordinate court to the High Court does not amount to a &quot;judgment&quot; under clause 15. The controlling test is whether the order conclusively determines a right or liability and finally disposes of the proceeding so far as the court is concerned. A transfer order does neither: it does not decide the merits, does not terminate the suit, and only changes the forum in which the same proceeding continues. On that reasoning, no appeal lies from such an order under clause 15.</description>
