    <title>1975 (10) TMI 118 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=287782</link>
<description>In proceedings under section 33 of the Industrial Disputes Act, 1947, a Tribunal cannot reappreciate evidence or sit in appeal over a fair domestic enquiry; interference is confined to cases where there is no legal evidence, the finding is perverse, or a prima facie case is absent. Victimisation based on trade union activity must be specifically pleaded and proved by safe and sure evidence, and it ordinarily cannot survive where gross misconduct is established on legal evidence. The Tribunal&#039;s refusal to grant approval and permission was therefore held erroneous, and the employer&#039;s applications were directed to be allowed.</description>
