    <description>After committal of a criminal case under Section 209 CrPC, the bar in Section 193 is lifted and the Court of Session may take cognizance of the offence with original jurisdiction. On that basis, it may summon persons not named in the charge-sheet if their prima facie involvement is disclosed from the material on record. Section 319 CrPC is confined to the course of enquiry or trial when evidence reveals the involvement of an unarraigned person, so it could not justify action before that stage. The summoning order was therefore supportable under Section 193, not Section 319.</description>
