    <description>A subordinate criminal court has no inherent power to recall or restore an order dismissing a complaint for default unless the Criminal Procedure Code expressly confers that authority. Once the dismissal order is acted upon, the court becomes functus officio in relation to that dismissal, and a fresh complaint cannot be treated as a revival of the earlier one. Article 141 makes the Supreme Court&#039;s declaration of law binding on all courts in pending proceedings, so the contrary view treating the ruling as confined to the parties was incorrect. The original dismissal order was therefore restored.</description>
