    <description>A mortgagee of a lessee&#039;s leasehold interest cannot claim rights greater than the lessee&#039;s. Where the lease expressly permits the lessor to terminate the lease and re-enter upon specified defaults, and consent to mortgage is subject to those lease rights, termination validly extinguishes the mortgagee&#039;s derivative security interest against the lessor. No separate notice to the mortgagee is required to preserve an interest that cannot survive the lessee&#039;s validly terminated leasehold estate. The mortgagee therefore cannot resist eviction, challenge recovery of possession, or assert a superior interest over the lessor.</description>
