    <description>At the stage of issuing process, the Magistrate must apply real judicial mind to whether the complaint and Sections 200 and 202 CrPC material disclose the essential ingredients of the alleged offence; where particulars of time, place, manner and specific overt acts are absent, process is unsustainable. The use of photocopies of disputed documents in pending company and civil proceedings, without dishonest intention, wrongful gain or wrongful loss, does not by itself amount to theft, dishonest misappropriation or receipt of stolen property. In the absence of a prima facie case, continuation of the criminal complaint was treated as an abuse of process and liable to be quashed.</description>
