    <description>A Letters Patent appeal from a Single Judge&#039;s decision in a first appeal is not restricted by the limitations applicable to a second appeal under Section 100 of the Code of Civil Procedure, 1908. The Clause 10 appellate power extends to the whole decree and allows re-examination of both fact and law because a Single Judge deciding a first appeal is not a court subordinate to the High Court for Section 100 purposes. Findings of fact may be reviewed, although such interference should ordinarily be exercised with caution. The Division Bench may therefore consider the entire matter in an appropriate Letters Patent appeal.</description>
