    <title>2010 (11) TMI 1080 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=276589</link>
<description>Criminal contempt, being quasi-criminal in nature, cannot be initiated on mere suspicion or because a pleading is disputed at a preliminary stage. A false plea alone does not automatically amount to contempt, especially where the underlying issue still requires adjudication on evidence and the party must have an opportunity to rebut any presumption of service. The contempt proceedings were also unsustainable because the mandatory procedure under the Contempt of Courts (C.A.T.) Rules, 1992 was not followed: no separate contempt case was registered, no charge was framed, and the required procedural safeguards were denied. The proceedings were therefore vitiated for breach of the rules and natural justice.</description>
