    <title>1966 (10) TMI 165 - ORISSA HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=276457</link>
<description>Under Section 6 of the Hindu Succession Act, a Mitakshara coparcener&#039;s interest on death after commencement of the Act is ascertained by a notional partition immediately before death. That fiction treats the coparcenary as disrupted only for the limited purpose of fixing the deceased&#039;s share, and it also gives the wife a share in that notional partition. The deceased&#039;s carved-out interest then devolves by succession under Sections 8 and 10 among Class I heirs. The earlier law under the Hindu Women&#039;s Right to Property Act was distinguished, and the trial court&#039;s computation of shares was upheld.</description>
