    <description>In a warrant case instituted otherwise than on a police report, the prosecution is not confined to the witnesses examined at the pre-charge stage. The scheme of Sections 244 to 246 of the Code of Criminal Procedure allows charge to be framed at an earlier stage and expressly permits the remaining prosecution witnesses to be examined afterwards. The court therefore held that the complainant could not be restricted to the pre-charge evidence alone, and additional witnesses could be led after framing of charge. The order imposing that restriction was set aside.</description>
