    <title>1997 (3) TMI 631 - BOMBAY HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=273349</link>
<description>Under the Bombay Public Trust Act, the High Court appeal under Section 72(4) is governed by the special statute&#039;s own appellate scheme and is not restricted to a second appeal under Section 100 CPC; the appeal may therefore be examined on facts as well as law. On the trust scheme, the Court sustained most structural amendments but confined membership and trusteeship to Christians connected with churches in the Nasik Diocese District, required the Chairman to be elected from among the trustees, and preserved the Bishop&#039;s role only as an ex officio trustee. The scheme was accordingly modified in part and affirmed in part.</description>
