    <title>1915 (4) TMI 1 - MADRAS HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=272885</link>
<description>A later limitation statute will not be construed to retrospectively destroy a vested right of suit that was alive when it commenced unless that intention is clearly expressed. The Madras HC held that exclusion of the Limitation Act under the Madras Estates Land Act did not operate to extinguish a pre-existing right of suit, particularly where the plaintiff&#039;s claim remained alive under the then governing law and the deferred commencement of the Act supported the contrary inference. The suits were therefore maintainable, the decrees below were set aside, and the matters were remanded for disposal according to law.</description>
