    <description>A Magistrate receiving a police final report cannot direct the police to submit a charge-sheet merely because he disagrees with a summary recommendation, as the police retain the statutory role of forming the investigative opinion. The Magistrate must instead act judicially: if the report is acceptable, he may endorse the appropriate summary; if the investigation is incomplete or unsatisfactory, he may order further investigation; and if the materials disclose an offence, he may take cognizance under Section 190(1)(b) or, on the report and accompanying papers, under Section 190(1)(c).</description>
