    <description>A private tenancy created in breach of a general letting prohibition under the U.P. (Temporary) Control of Rent and Eviction Act, 1947 is void, because the general order has the force of law and an agreement made in violation of it is forbidden by law under Section 23 of the Contract Act, 1872. Occupation under such an unlawful arrangement can be ignored in law, so the accommodation remains vacant for allotment purposes. The District Magistrate may therefore invoke Section 7-A to evict the unauthorised occupier and place the allottee in possession, even if the allotment order was passed after the unauthorised letting.</description>
