    <title>1958 (1) TMI 36 - BOMBAY HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=199428</link>
<description>A public trust left in serious internal dispute, with rival claims to membership and office and no properly constituted managing committee, was treated as being in practical standstill. On that basis, protective appointment of a Court Receiver to manage trust property was considered justified during pendency of the suit. Civil court jurisdiction was also upheld because the trust was registered as a public trust within the forum&#039;s territorial jurisdiction, its property and administration were locally situated, and objections based on foreign origin or claimed sovereign control were rejected. The Receiver&#039;s use of assistance from a person previously connected with management was not found objectionable.</description>
